I don't quote verbatim, but that was the gist of the argument when Surkeir (as he then wasn't) defended Josh Richards, one of a gang of hooligans who broke into RAF Fairford in Gloucestershire intending to sabotage US bombers during the Iraq war in 2003.
If he was still working as a yuman rites brief, one can imagine Starmer advancing the same defence in court today, on behalf of the Palestine Action headbangers who caused anything up to £30 million of damage to planes at RAF Brize Norton, depending on which guesstimates you believe.
They, too, claimed to be acting out of peaceful motives aimed at preventing British involvement in the US/Israel war on Iran.
In this case, the perpetrators were carrying paint, not petrol, but their intent was identical. Forget fashionable euphemisms such as 'raising awareness' and 'vandalism', this was sabotage pure and simple, aimed at the very heart of Britain's defences. There is a case to be made that it was treason, a crime which used to be punishable by hanging.

They should have been shot on sight. In another lifetime they'd have been doing the Tyburn Jig in double-quick order. Unfortunately, they weren't even seen. As of last night, no one had been nicked.
No doubt interviews without coffee have already taken place and a number of RAF brass hats/military police chiefs/lower-level Funny People are already clearing their lockers and preparing for post-service careers as Sky News pundits.
But that's not what this column is about. Instead, let's play 'What If?' What if the planes they put out of service were about to become operational? What if they were due to take off to refuel the US Stealth bombers headed for Iran's nuclear facilities? This self-indulgent, self-publicising stunt could have scuppered the entire mission and Iran could be nearer building their bomb.
To say nothing about the way it could have destroyed any remaining trust afforded to Britain by our most important, and powerful, NATO ally, the US.
By their own admission, Palestine Action accepts that Tehran is the puppetmaster of Hamas. They couldn't have made it more obvious if they'd paraglided into RAF Brize Norton.
They may only be a bunch of deranged losers living in a squat above an Albanian kebab shop in Stoke Newington. But just because they're gormless, it doesn't mean that Palestine Action is any less dangerous.
These thugs have also attacked a Jewish business in North London and taken a sledgehammer to a copper. So shame on their apologists, from 'Baroness' Chakrabarti, author of Corbyn's anti-Semitism whitewash, to Normal People's Sally Rooney. There's nothing 'normal' about rampant Jew-hatred, pet.
Even useful idiots can do considerable damage, as this Government has now belatedly recognised.
You know things are getting serious when even the useless, prevaricating Met Commissioner Mark Rowley is moved to declare Palestine Action a 'terrorist' group.
Rowley couldn't have done more to enable the neo-fascist, pro-Hamas, anti-Semite, anti-Israel marchers polluting the streets of London most weeks if he'd volunteered to act as chief steward while dressed as Yasser Arafat in an intifada headscarf.
Why should we have to tolerate far-Left lunatics waving the flags of our enemies and terrifying our friends and neighbours in Britain's loyal, law-abiding Jewish community?
The usual, soap-dodging suspects were out on the streets again yesterday in support of Palestine Action. (Presumably they were all 'working from home'.)
Now that Home Secretary Pixie Balls-Cooper is about to officially designate Palestine Action as terrorists, will Rowley crack down on both them and the other assorted jihad-friendly supporters deemed protected by 'free speech'? I wouldn't bank on it, not while there are online 'hate crimes' to be investigated and robberies to be ignored.

We now live in a country where acts of sabotage and public disorder are tolerated by the authorities provided they are in furtherance of what we used to call 'politically correct' causes. Look how XR nutjobs regularly walk free from court for blocking our streets, alongside skateboarding Plods.
Only last year, five Palestine Action 'activists' were found not guilty after bringing to a standstill a factory in Kent owned by an Israeli arms manufacturer. They meant well, bless 'em.

What are the chances of the RAF Brize Norton saboteurs ever seeing the inside of a cell at Belmarsh - if they're ever caught?
They'll always manage to find a sympathetic brief like the young Surkeir to argue that their actions were perfectly legal as well as morally justifiable.
He may now be trotting out the line that these people are 'terrorists' but in his heart of hearts does he actually believe any of the expedient platitudes he's spouting at the moment?
Every time that I hear Surkeir talking tough I come over all Peter Sarstedt. But where do you go to, my lovely, when you're alone in your bed?
Is Starmer still the idealistic, young yuman rites lawyer, prepared to defend criminals who break into RAF bases? That would be my best guess, despite the noises coming out of No 10.
Lawyers with despicable clients always fall back on the 'cab rank' principle, suggesting they have to take whatever cases come along.

Frankly, I've never believed a word of it. As I've pointed out time and again, that depends on where you park your cab. Outside a fancy West End restaurant, you'll pick up a wealthy celeb or captain of industry.
If you park it outside Finsbury Park mosque you'll get Captain Hook. (Or in the case of Starmer's mate 'Lord' Hermer, if you park it in Main Street, Mauritius, you can go south of the river and no one will quibble about the bill.)
For the moment, Surkeir's parked outside No 10. But you can bet your life that in a previous incarnation, if the case of the Brize Norton saboteurs had landed in his chambers, he'd have been the first cab on the rank.
During the Iraq war, Surkeir also defended a woman called Lindis Percy, who was arrested over 500 times for breaking into and protesting outside RAF and US bases, an achievement of which he remains extremely proud.
As The Mail on Sunday reported: 'In January 2020, when he was running for the Labour leadership, Sir Keir featured Ms Percy in his campaign launch video, in which she said, against the backdrop of their images of campaigners: 'Keir defended me, and many others, to bring public scrutiny and awareness to the presence of the US visiting forces so that we can live in a more peaceful and less secretive society. [He] never asked for anything in return.'
Oh, and incidentally. If you're wondering what was the verdict in the RAF Fairford trial where Surkeir presented the defence . . . the case collapsed and his client got off. It obviously set something of a precedent.
So when the Brize Norton nutjobs and their soon-to-be proscribed terrorist sidekicks in Palestine Action are acquitted - that's if they're ever caught - you'll know who to blame.
Especially if Surkeir agrees to appear for the prosecution!
